take Route 585 north approx. 4 miles to Fulton Road and auction.
REAL ESTATE: We are very excited
and privileged to offer the Berkey property at absolute auction. This
is a great opportunity to purchase all or part of a rare property. Farm
will be offered in 8 parcels and also some combinations. Parcel #1 is
the location of the farmhouse, bank barn, 2-car garage, and approx.
12 acres with frontage on Rt. 585 and Fulton Rd. Parcels #2 and #3 are
great building sites adjacent to the east of Parcel #1 and on Fulton
Rd. They are approx. 4 acres. Parcels #4 and #5 are open tracts of land
west of Rt. 585 and approx. 10 and 11 acres in size. Parcel #4 has frontage
on Rt. 585 and Fulton Rd. Then comes Parcels 6, 7, 8 - wooded lots that
are secluded and range from 3.4 to 5.5 acres - really a great location.
Parcel #8 is the corner lot with frontage on Fulton and Blough roads.
Parcel #7 has frontage on Blough Rd. and Parcel #6 has a 50' right of
way off Fulton Rd. Parcels will carry some general deed restrictions.

TAX & LEGAL: Located in Milton
Twp., Wayne County, and the North Central School District. Taxes are
currently under CAUV and will be prorated to the day of closing in approx.
60 days. Any CAUV recoupment will be a buyer's expense and those approx.
figures will be posted sale day. Sellers will split the cost of an owner's
title insurance policy.
TERMS: A non-refundable down payment
of 10% of the purchase price to be paid on sale day by cash or good
check. Balance due at closing. There are no financing contingencies.
All desired inspections must be made prior to bidding. Sale day announcements
take precedence over printed advertising. A fee of $400.00 per parcel
will be charged to assist with survey and soil evaluations. Property
sells with your inspection in its current condition. Realtor referrals
must be completed 48 hours prior to auction. Acreages are approximate
and will be adjusted with the final survey. For any questions, call

DEED RESTRICTIONS:
1. No trailers, mobile homes, or basement houses (a home with no exposed
living space above ground) shall be used for a permanent or temporary
dwelling on any parcel.
2. Manufactured homes or modular homes must have a basement or placed
on a permanent foundation, be taxed as real estate, and meet the square
footage requirements in #3.
3. No single story home constructed shall be less than 1,500 square
feet of first floor living area, no two story home shall have less than
1,800 square feet, and no split level shall have less than 1,650 square
feet of living area. Attached garages and open porches are not part
of the living space for square footage calculations.
4. No lot or any part thereof shall be used for rubbish, trash, or any
other waste dumping ground.
5. No disabled or unlicensed vehicles to be parked outside.
6. No large commercial manufacturing or warehouse facilities.
7. No high density raising of livestock or fowl shall be permitted on
these parcels.
8. These restrictions do not prohibit the construction of a barn for
non-commercial use of the owner.
These deed restrictions will not be applied if a combination occurs
on Parcels 1-3; Parcels 4-8; or Parcels 1-8.
